Acceptance of terms
By accessing our website, submitting an enquiry, responding to our Meta (Facebook or Instagram) ads, or purchasing our services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website or services.
If you accept on behalf of a business, you confirm that you have authority to bind that business.

Eligibility and age
Our website and services are intended for businesses and individuals aged 18 or over. By using our services, you confirm that you meet this requirement.

Services we provide
We provide professional digital services that may include logo and branding design, UI/UX and mobile app design, web development, app and software development, e-commerce solutions, SEO, PPC, social media marketing, content, photography, and related consulting.
Exact deliverables, timelines, fees, and milestones are set out in a quote, proposal, order confirmation, or written agreement for each project. Where a project agreement conflicts with these Terms on project-specific points, the project agreement prevails for that project.
Advertising claims on Meta or other channels describe our general services. Final scope and pricing are confirmed in writing before paid work begins.

Website use and advertising accuracy
You agree to use our website and services lawfully and honestly. You must not misuse the site, attempt unauthorised access, submit false information, or use our services for illegal, fraudulent, or infringing activity.
We aim to keep website and ad content accurate. Examples, case studies, prices, and timelines are illustrative unless confirmed in a written quote. Results vary by project, industry, and client inputs. We do not guarantee specific rankings, revenue, or business outcomes unless expressly stated in a signed agreement.

Enquiries, quotes and Meta leads
When you submit a contact form, Lead Ad, or other enquiry (including via Meta Ads), you confirm that the details you provide are accurate and that we may contact you by email, phone, or messaging apps about your request.
Submitting an enquiry does not create a binding project contract until both parties agree scope and payment terms in writing. Lead and enquiry data is handled as described in our Privacy Policy.

Client responsibilities
Clients must provide timely access to content, brand assets, feedback, and approvals needed to deliver the project. Delays in client input may extend timelines.
Clients warrant that materials they supply (logos, copy, images, data) do not infringe third-party rights and that they have permission to use them. Clients are responsible for the legality of their own business claims, regulated industry disclosures, and final published content unless we have expressly agreed otherwise in writing.

Payments and deliverables
Fees, deposits, payment schedules, and accepted payment methods are stated in your quote or invoice. Work may pause if invoices are overdue.
Unless otherwise agreed, final design files, code, credentials, or campaign assets are released after cleared payment of amounts due for those deliverables.
Third-party costs (domain, hosting, stock assets, ad spend, app store fees, licensed plugins) are usually payable by the client and are separate from our service fees unless the quote says otherwise.

Refunds and cancellations
Because our services are custom digital work, refunds are limited:
- Once project work has started or initial concepts have been delivered, fees for work already performed are non-refundable.
- If we have not started work within 7 days of receiving cleared payment due to our delay, you may request a full refund of unused fees.
- Completed or delivered design files, websites, applications, or marketing campaign setups are not refundable.
- Paid media spend on Meta or other ad platforms is controlled by the advertising platform and is generally non-refundable once spent.
- Cancellation requests must be emailed to info@ukcreativedesign.com. We will confirm any amounts due for work completed to the cancellation date.

Intellectual property
Our pre-existing tools, frameworks, templates, know-how, and brand assets remain our property. Upon full payment for a deliverable, the client receives ownership of the final custom deliverable created specifically for them, unless a different licence is agreed in writing.
Portfolio use: unless you opt out in writing, we may display completed work in our portfolio, case studies, and marketing (including social media), without disclosing confidential commercial information.

Confidentiality
Each party should keep confidential information received from the other reasonably secure and use it only for the project, except where disclosure is required by law or the information is already public through no fault of the receiving party.

Third-party platforms and tools
Services may rely on third-party platforms such as hosting providers, domain registrars, analytics tools, payment gateways, app stores, and advertising platforms including Meta. We are not responsible for outages, policy changes, account suspensions, or limitations imposed by those providers.
If we manage Meta Ads or similar campaigns for you, you remain the advertiser of record for your products/services and must comply with Meta Advertising Standards and applicable law. You must provide accurate business information for Business Manager verification when required.

Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or pure economic loss, including lost profits, lost data, business interruption, or reputational harm, arising from use of the website or services.
Our total aggregate liability arising out of any project is limited to the fees you paid us for that project in the 3 months before the claim, except where liability cannot be limited by law (including death or personal injury caused by negligence, or fraud).

Privacy
Personal data is processed in accordance with our Privacy Policy, which forms part of these Terms and explains how we handle website, enquiry, and Meta Ads-related data.

Changes to these terms
We may update these Terms from time to time. The “Last updated” date on this page will change when we do. Continued use of the website after changes means you accept the updated Terms for future use. Existing signed project agreements are not changed retrospectively except by mutual written agreement.

Governing law
These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, without prejudice to any mandatory consumer protections that may apply if you are contracting as a consumer.
